Welcome to WawCar. These Terms of Use ("Terms") govern your access to and use of the WawCar mobile application (the "App"), operated by Mark Albokrinov, doing business as WawCar, based in Warsaw, Poland.
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
WawCar is a peer-to-peer (P2P) marketplace for used cars. WawCar is a platform only — we are not a party to any transaction between buyers and sellers, and do not verify vehicle condition, legality, or listing accuracy. Any sale is a private transaction between buyer and seller, outside of the App.
Anyone may browse without an account. You must be at least 18 to create an account, post a listing, or use chat, and you represent that your registration information is accurate.
You're responsible for your account's confidentiality and activity. Don't provide false information, impersonate others, or create unauthorized accounts. We may suspend accounts that violate these Terms.
By posting a listing, you confirm you own or are authorized to sell the vehicle, that all listing information is truthful, and that photos depict the actual vehicle. You won't list stolen or illegally-documented vehicles, or post fraudulent, offensive, or infringing content. You grant WawCar a license to host and display your content to operate the service. We may remove any content at our discretion.
After a listing is marked sold, the buyer and seller may rate each other from 1 to 5 stars and leave a comment. A rating is permanent once submitted, tied to your public profile, and cannot be edited or withdrawn. Ratings must reflect your honest experience — don't post false, retaliatory, or defamatory ratings, and don't rate a deal you weren't actually part of.
No unlawful use, false listings, harassment, spam, fraud, scraping, interference with the App's security, fee circumvention, or duplicate accounts to evade restrictions.
Use the in-app chat responsibly. Meet in safe public locations for inspections, verify vehicle documentation, and never send advance payments to strangers. WawCar isn't responsible for user conduct inside or outside the App.
Your first active listing is free. Keeping more than one listing active at a time requires a paid 30-day period, currently 19 zł (standard) or 29 zł (boosted); a one-time boost add-on for an existing listing is currently 10 zł. Chat is free and unlimited. All payments are processed through Apple's In-App Purchase system and are subject to Apple's own terms. Paid periods are non-refundable except as required by Apple's refund policies or applicable law; deleting your account or a listing does not entitle you to a refund of any unused period. Prices may change; the price shown in the App at the time of purchase applies.
The App's design, branding, and software (excluding User Content) belong to WawCar. Don't copy or redistribute without written consent.
You may delete your account anytime. We may suspend or terminate accounts that violate these Terms or harm the platform's integrity.
The App is provided "as is," without warranties of accuracy, reliability, or uninterrupted service. We aren't responsible for vehicle condition, listing accuracy, or a seller's/buyer's ability to complete a transaction.
To the maximum extent permitted by law, WawCar isn't liable for indirect damages or damages arising from user transactions or disputes. Nothing here limits liability that can't be excluded under Polish/EU consumer protection law.
You agree to indemnify WawCar against claims arising from your User Content, your violation of these Terms or the law, or disputes with other users.
Your use of the App is also governed by our Privacy Policy.
We may update these Terms; material changes will be communicated before taking effect. Continued use means acceptance.
These Terms are governed by Polish law. EU consumer users retain mandatory rights under their home country's law and may use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
If any provision is invalid, the rest remains in effect.
